Asus x53e brand new with windows 7 but battery won't charge to 100%...only goes to 97% or 98% when it feels like it.

Bought a brand new asus x53e and have had it for about a week now.
Ever since the first time the battery never charged to 100%. Every-time it either goes to 97% or 98% but i have yet never seen this to go to 100%
I have tried letting the battery fully drain and recharge, tried cleaning the contacts(even though its a brand new laptop), tried battery recalibration software and i'm at a loss and thinking Microsoft messed up something with Windows 7.

The laptop in question is
Asus x53e(uses k53 motherboard)
i7 2670 @ 2.2ghz
windows 7 premium
6gb ram
750gb hd

It is early to come to a conclusion that it is an issue with Windows 7 unless a replacement of the battery is already done.
